San Benito, TX (KRGV) — Jurors ended deliberations on Friday on whether convicted killer Rogelio Martinez should get the death penalty or life in prison without parole for killing San Benito police Lt. Milton Resendez.

Deliberations will continue on Monday.

Jurors went behind closed doors at 8:30 a.m. and went home without reaching a decision.

Martinez was found guilty earlier this month of killing Lt. Resendez during a police chase in 2023.

Throughout the week, jurors heard two very different arguments about Martinez. Prosecutors say he remains a danger to others, but his attorneys say his childhood and mental health history should spare him from the death penalty.

The defense called psychologists who testified about his mental health struggles and years of abuse and neglect while he was growing up.

One expert said Child Protective Services had been involved with his family about 75 times.

Another expert said Martinez is unlikely to commit serious violence if he spends the rest of his life in prison. Prosecutors pointed to his history of trouble with the law, including incidents while he has been in jail.

Prosecutors also argued his childhood does not excuse his actions. Jurors also heard from Lt. Resendez's widow, who described how difficult life is without her husband.

Prosecutors are asking for the death penalty. The defense asked for life in prison without parole.
