The Cameron County District Attorney's Office says a trial for a deadly 2021 crash in La Feria has been postponed for the 10th time.

The trial for Jaime Carlos Guerra was set to begin on Monday. Instead, a judge agreed to push the trial back to August at the request of the defense.

Guerra, a former La Feria High School assistant coach, is charged with accident involving death and tampering with evidence in connection with the Oct. 30, 2021 crash that killed Robin Lee Hernandez.

As previously reported, Hernandez’s body was found that day off West Frontage 83. According to a police affidavit, Hernandez was walking on the road when he was hit by a black truck, and the driver sped off shortly after. 

Police say Jaime Carlos Guerra was driving the truck. Surveillance footage showed Guerra stopped briefly before taking off.

The victim's mother, Ginger Poynter, says the delays add to the emotional toll.

"It hurts. It gets a little easier with time, but when I talk about him, it does hurt," Poynter said.

Hernandez was a U.S. Marine who served three tours in Iraq. He left behind twins who continue to grow.

"I hate that we keep celebrating these milestones and he's not here to celebrate with us. The pain, it never goes away," Poynter said.

Poynter lives in Alabama and said she had her bags packed, ready to head down to the Rio Grande Valley, but a phone call from the Cameron County District Attorney's Office stopped her.

The defense attorney, Dan Sanchez, asked for the trial date to be reset because he said he needed more time to take a class for continuing legal education.

Poynter says the years of waiting have been frustrating.

"I'm a former prosecutor. I understand that it's very complicated to make a trial come together. You have to make your witnesses available... but I do believe Mr. Guerra is taking advantage of the system and has [delayed] the case more than it should be," Poynter said.

A judge has granted the defense's request to postpone the trial for several reasons, including the defense needing an expert or the defense attorney's need for more time because of his case load.

Robert Garcia, the CEO of Rio Grande Valley Families and Friends of Murdered Children Inc.,  says these delays take an emotional toll on the families.

"Every time a family is set to go to trial and it's postponed, it reoffends, unintentionally revictimized by the system that is there intended to protect them," Garcia said.

Poynter says this is a feeling she is familiar with.

"My husband even commented that he can tell my anxiety level goes up, just preparing my victim impact statement as to how this death has affected me and my son's children," Poynter said.

The Cameron County District Attorney's Office said in a statement they were disappointed in the decision.

The new trial is set for Aug. 17, 2026.
