A Hidalgo County judge may lower the $3.25 million bond for a man charged in a deadly motorcycle crash in Mission if the suspect doesn’t receive further medical attention.

Apolonio Perez appeared in court on Tuesday, where his attorneys said an emergency surgery scheduled for last week did not happen. They claim someone with the county, not a doctor, stopped it from happening.

Perez is in custody on charges of murder, intoxication manslaughter with a vehicle, and evading arrest causing death in connection with the May 3 crash that killed John Alonso.

According to a crash report obtained by Channel 5 News, Perez collided with another motorcyclist, identified as Alonso, while attempting to evade a trooper with the Texas Department of Public Safety.

The report says a trooper was attempting to conduct a traffic stop on Perez on the expressway. Perez exited the expressway at Inspiration Road and drove into oncoming traffic, causing the collision on the westbound Frontage Road near Holland Avenue.

Perez remains wheelchair-bound. The crash report said Perez suffered a broken arm and leg in the crash. 

Alonso’s family was in court for the hearing.

"We're going to continue the fight for him, for justice, and just continue keeping his memory alive with us," John Alonso's sister-in-law Erica Alonso said. "And this is just the beginning of a long fight for him."

In a previous hearing, Perez’s defense team said the suspect was not receiving proper medical treatment for a dislocated shoulder and that he has nerve damage and his right leg can't stand the weight of his body.

A judge previously declined two bond reduction requests from Perez’s legal team. On Tuesday, 332nd District Court Judge Juan R. Alvarez said he would consider lowering it due to his medical issues.

A hearing was set for Tuesday, Sept. 29.
