Silva was charged alongside coworker Sendy Ruiz. Ruiz pleaded not guilty to the charge and has a hearing set for December 11, 2025.
Logan died after he had been left in a van for nearly five hours following a field trip, according to previous reports.
Investigators said Logan was left inside the daycare van for around five hours.
During Thursday’s sentencing hearing, prosecutors said officers checked the temperature of the van that day and found it to be at 120°F.
Silva was identified as the driver of the van. She and Ruiz were also identified as the woman in charge of the van and the children in it.
Silva, who is seven months pregnant, showed up to her sentencing hearing in a white dress and cried on the stand as she apologized to Logan's family.
At one point, Silva directly addressed Logan's mom and said she wished she would have looked back before getting off the van, so Logan's death could have been avoided.
Silva’s defense team said Silva was taking accountability for her actions, and that she was not the only daycare staff member responsible for Logan’s death.
Defense attorneys also claimed that the daycare owner — Marylou Galindo — undertrained employees and ignored safety concerns
Galindo is not facing charges in connection with Logan's death.
Logan's mom also testified and cried as she described how much she misses her son
She also said she doesn't hate Silva, but asked 445th District Court Judge Gloria M. Rincones to hand down the maximum sentence of 20 years
Rincones sentenced Silva to five years in prison.
Since her arrest, Silva has been in custody on an ICE detainer after authorities said she overstayed on a visa. She will be deported after serving her sentence.
