UPDATE (2/7): The Mission City Council voted unanimously a lawsuit filed against a firefighter battling cancer.

The city council declared yesterday they don't want to have anything to do with the lawsuit.

"I put forward a motion to that council before TMLIRP Board and state thereof their position that we are not in favor of this appeal in hopes that it either be dropped or resolved without denying Mr. Salinas any future pay."

In public statements, the city said they don't want the firefighter to be denied any benefits.

MISSION – The city of Mission is suing one of its own firefighters who battled cancer a few months back.

The city claims it did not know anything about the case before it was filed.

Homer Salinas says he thought his court case was closed and is shocked to find out he is being sued again by the city’s self-insurer.

"I have gone through two BRC's which is benefit renew council, I have gone through contested court hearing and I won that. I gone through a three judge appeal panel and they ruled in my favor,” he explains.

Texas Municipal League first denied his worker’s compensation; he was eventually awarded his benefits.

KRGV’s Angelo Vargas explains the statement released by the city of Mission, which says they were not notified in advance.
